Bill C-39 Bill C-39, An Act respecting certain measures to strengthen the economy

Introduced on September 21, 2026, Bill C-39 is a sweeping piece of legislation designed to accelerate major infrastructure approvals and streamline regulatory measures, among other features. This piece of legislation introduces significant measures to streamline major project evaluations, regulatory processes, and supply chains in the name of economic certainty. Part 1, notably amends the Impact Assessment Act, the Building Canada Act (C-5), and the Canadian Energy Regulator Act.

On September 21, 2026, the Minister of Transport and the Leader of the Government in the House of Commons introduced Bill C-39. The omnibus bill is broken down into three (3) parts: Part 1 – Build Canada Now; Part 2 – Keep Canada Moving; and Part 3 – Canada Strong for All.

Parts 1 and 2 of the bill advance measures that were originally proposed in two discussion papers published by the Government of Canada on May 8, 2026: “Getting Major Projects Built in Canada” and “Strengthening One Canadian Economy Through Trade and Transportation”. AFN’s response to these discussion papers provides a legal analysis of these measures.

It is expected that this will move through the legislative process in an expedited manner.
